WHAT ARE THE IRS GUIDELINES FOR WRITING OFF INJURY RELATED MEDICAL EXPENSES?
In general, taxpayers who itemize deductions may deduct unreimbursed medical expenses that exceed 7.5 percent of the Adjusted Gross Income listed on the return.
This means medical expenses covered under a health insurance policy are not tax- deductible. However, if the insurance payment is less than the provider’s charge for an eligible service, the patient can deduct the amount paid out-of-pocket.
Further, only medical services, medications and treatments that alleviate or prevent a specific physical or mental condition or illness are tax-deductible. Expenses for items or services that benefit general health, such as vitamins or spa visits, do not qualify.
When there is a specific medical condition, deductions may be taken for the cost of services related to the following:
- Diagnosis
- Cure
- Mitigation
- Treatment
- Prevention
In addition, the cost of items required for the above purposes may also be deducted, including:
- Equipment
- Supplies
- Diagnostic devices
DO SERVICES HAVE TO BE PROVIDED BY CERTAIN TYPES OF MEDICAL PRACTITIONERS TO QUALIFY FOR TAX DEDUCTIONS?
Deductions are permitted for eligible, unreimbursed services provided by a wide range of qualified medical practitioners, including but not limited to the following:
- Acupuncturists
- Chiropractors
- Dentists (excluding routine or cosmetic services)
- Surgeons
- Ophthalmologists and optometrists (excluding routine exams)
- Medical doctors (MDs) of all specialties
WHAT MEDICAL EXPENSES ARE ELIGIBLE FOR TAX WRITE-OFFS?
With the exception of health insurance premiums, medical services and medications must be related to the treatment or prevention of a specific mental or physical illness or condition in order to be tax-deductible. As stated earlier, expenses reimbursed by health insurance policies or other sources do not qualify for tax deductions.
Providing the above conditions are met, the following medical expenses may be tax-deductible:
- Qualified long-term care services
- False teeth
- Prescription eyeglasses or contact lenses
- Hearing aids
- Guide dogs or other service animals to assist individuals with visual or hearing impairments or other physical disabilities
- Crutches, wheelchairs and other necessary assistive devices
- And more…

WHAT KINDS OF MEDICAL EXPENSES ARE NOT ELIGIBLE FOR TAX DEDUCTIONS?
- Cosmetic surgery, unless it is related to:
- Congenital abnormality
- Accident
- Disease
- Nursing care for a healthy baby
- Most drugs not approved by the FDA
- Funeral, burial, or cremation costs
- Most nonprescription medicines
- Toothpaste, toiletries and cosmetics.
- Expenses for trips or programs for general health improvement
- Amounts paid for nicotine gum and nicotine patches that don’t require a prescription
ARE HEALTH INSURANCE PREMIUMS TAX-DEDUCTIBLE?
Yes, in some situations insurance premiums for policies that cover medical care or qualified long-term care can be deducted, including premiums for policies purchased by self-employed individuals for themselves, their spouses and dependents.
Fore example, medicare premiums are tax-deductible as follows:
- Medicare A premiums (usually free for individuals covered by Social Security)
- Medicare B supplemental insurance
- Medicare D insurance
- Medicare supplemental insurance premiums
CAN I DEDUCT COMPENSATION FROM A PERSONAL INJURY LAWSUIT?

NEW MICHIGAN CAR SEAT LAWS 2 Apr 2025, 5:22 pm
Car accidents are the leading cause of death for children under 13, according to data from Michigan State Police. The good news is that using the proper car seat, booster seat or seat belt can help reduce this risk by 50 percent. Effective April 2, 2025, new Michigan car seat laws increase protection for the youngest, most vulnerable passengers. Unfortunately, the most stringent safety precautions cannot prevent every accident. WHAT IS INCLUDED IN THE NEW MICHIGAN CAR SEAT LAWS?
In addition to requiring that children be secured in a car seat or booster seat appropriate for their age, weight and height according to instructions from the car seat’s manufacturer, the new laws include specific changes for transporting young passengers
Here is a summary of the updated car seat laws that take effect April 2, 2025:
Infants – two years
Infants and toddlers must be in a rear-facing car seat until they reach the maximum weight or height allowed by the car seat’s manufacturer or turn two years old, whichever occurs first.
Under the old law, only children under the age of one had to ride in rear-facing car seats.
Two – five years
Children should use a forward-facing car seat with an internal harness until they reach the maximum weight or height allowed by the car seat manufacturer or turn five years old, whichever occurs first.
The previous law required the use of forward-facing car seats for children up to the age of four.
Five – eight years
Children should use a belt-positioning booster seat using a lap-and-shoulder belt until they are 4 ft., 9 in. tall or turn eight years old, whichever occurs first.
All children under 13
Children must use seat belts after they have outgrown the height and weight limits of their booster seat. For maximum protection, children should use the lap/shoulder belt rather than the lap-only belt found in the back seats of certain vehicles.
In addition, any passenger under the age of 13 should ride in the rear seat of a vehicle whenever possible.
WHAT IF A REAR SEAT IS NOT AVAILABLE?
If all available rear seats are occupied by children under four, then passengers under four may ride in the front seat using the appropriate car seat or booster for their height, weight and age.
When transporting young children in a vehicle that does not have a back seat, such as a pick-up truck, children may ride in the front seat using the appropriate car seat or booster for their height, weight and age.
However, the airbag must be turned off whenever a child in a rear-facing car seat rides in the front seat.
DO MICHIGAN CAR SEAT LAWS APPLY TO TRUCKS AND SUVS?
Yes. These updated laws apply to all passenger vehicles, including trucks and SUVs.
MAKE SURE YOUR CAR SEAT IS PROPERLY INSTALLED
More than 70 percent of car seats are improperly installed, which means they cannot provide adequate protection in the event of a crash.
Here are some of the most common installation mistakes:
- Loose harness straps
- Straps should fit snugly against the child so there is no slack when straps are fastened
- Car seat is not fastened securely in the vehicle
- You should not be able to move a car seat more than one inch from either side at the point where the seat attaches to the vehicle
- Using a seat that is the wrong size or style
- Use the car seat that is appropriate for the height, weight or age limits specified by the manufacturer
- Improperly positioned chest clip
- Secure the chest clip level with the child’s armpits to ensure straps remain in the correct position
- Putting kids in the front seat too early
- If a crash occurs, children under 13 can be seriously hurt by the force of an air bag

BE A GOOD ROLE MODEL: WEAR YOUR SEAT BELT AND AVOID DISTRACTIONS

Here are some ways to encourage young passengers to use seat belts:
- Clearly communicate the safety rules for riding in a car
- Praise children for positive behavior
- Demonstrate safe driving habits by using seat belts and avoiding distractions
- Explain the importance of wearing seat belts even on short trips
- Teach older children to wear seat belts in the back seat, even after they exceed the legal requirement (16 and older)

- Halloween is an outgrowth of Samhain, a 600 A.D. Gaelic festival celebrating the end of summer. In the eighth century, Pope Gregory III designated November 1 as “All Saints Day” and the night before was called “All Hallow’s Eve,” which later evolved to “Halloween.”

Driving under the influence of alcohol and/or drugs is one of the major causes of fatal car accidents across the country, and Michigan is no exception. According to data from Michigan State Police, 43.2 percent of drivers killed in crashes from 2019 to 2023 were alcohol- and/or drug-impaired.
Last year alone, there were 8,817 alcohol-involved crashes (resulting in 297 fatalities) and 2,250 drug-involved crashes (with 256 fatalities), according to the University of Michigan Transportation Research Institute.

Yes. Holiday travel often includes distractions such as multiple passengers, eating and drinking in the vehicle and increased use of GPS apps.
In 2023, distracted driving rose to 13.5% on Labor Day compared to the Mondays before and after the holiday, according to statistics from Cambridge Mobile Telematics. This means drivers spent approximately 2.17 minutes per hour using their phones on the holiday. CMT research showed the fatality rate rose 1.5 percent for every 10 percent increase in distracted driving.

DO LIABILITY WAIVERS PREVENT VICTIMS FROM FILING PERSONAL INJURY LAWSUITS? 9 Aug 2024, 3:42 pm
Signing a liability waiver is a customary procedure at venues such as fitness centers, bicycle and boat rentals, ski resorts, local sports programs and summer camps. In fact, although a business cannot force patrons to sign a waiver, they can deny admission to those who refuse to comply. Unfortunately, this leads many people to sign documents without reading or understanding what they are agreeing to. While signing a waiver may feel routine, it can be extremely problematic when someone is involved in a personal injury lawsuit.
However, while signing a waiver creates challenges, it is possible to sue a provider and receive compensation with the help of an experienced personal injury lawyer.
WHAT IS A LIABILITY WAIVER?
In simplest terms, a liability waiver is a contract that releases a provider, such as a camp or fitness center, from responsibility if a participant is injured. Signing one of these documents, also known as “hold harmless” clauses, means you understand the inherent risks of the activity and agree not to take legal action against the business for any injuries or damages you (or your minor child) sustain.
In addition, some liability waivers include an indemnity agreement, which is used when a participant is injured and files a claim against the business. A typical liability waiver exempts a business from ordinary negligence, when a provider breaches their duty to maintain a safe environment. To prevail in a personal injury lawsuit when a waiver has been signed, the plaintiff must prove the establishment is guilty of gross negligence, which typically involves recklessness or intentional harm.
However, the difference between ordinary and gross negligence can be a fine line. For example, a bump in a rug that causes someone to trip is more likely to fall under the category of ordinary negligence. In contrast, exposed electrical wiring that causes a visitor to be seriously injured may be considered gross negligence that is grounds for a personal injury lawsuit.
Nevertheless, because each case involves different circumstances, there are always exceptions to these guidelines. Therefore, it is best to contact a knowledgeable personal injury attorney if you are injured after signing a liability waiver.

ARE LIABILITY WAIVERS ENFORCEABLE UNDER MICHIGAN LAW?
In Michigan, liability waivers are enforced more stringently than in many other states. However, these waivers may be deemed invalid in certain situations.
Here are some reasons a court may rule that a waiver is not enforceable:
- The language of the waiver is unclear or ambiguous.
- The waiver did not list the “inherent risks” of an activity.
- The provider was guilty of extreme negligence, reckless behavior or intentional actions that resulted in the harm or injury.
- The provider attempted to obscure the waiver. An example would be placing it in the middle of a gym membership contract without any delineation.
WHAT HAPPENS IF I SIGN A LIABILITY WAIVER ON BEHALF OF MY MINOR CHILDREN?
Contracts signed by minors (under 18) are not legally binding under Michigan law, including liability waivers. But, when a parent signs a waiver on a child’s behalf, the rules are more complicated.
In 2010, the Michigan Supreme Court ruled that parents cannot legally waive liability on behalf of a child. Then, in 2011, a new law allowed businesses to enforce liability waivers signed by parents of minors. However, these waivers are only enforceable under very specific circumstances:
- The recreational activities must be sponsored or organized by non-governmental, non-profit organizations.
- The law does not apply to activities provided by for-profit companies or governmental bodies, such as schools.
- If an injury was caused by negligence or reckless behavior on the part of the organization or its employees, the waiver is not enforceable.

CAN I FILE A PERSONAL INJURY LAWSUIT AFTER SIGNING A WAIVER?
Sometimes. Like many areas of the law, the legal issues surrounding liability waivers are complicated. Depending on the circumstances, a victim who signed a waiver may still be able to sue a provider, especially if the business was negligent or their equipment was faulty. However, to prevail in a lawsuit, the plaintiff must prove the injury resulted from gross negligence on the party of the provider.
Another factor is the language of the liability waiver. If a document was unclear or written in “legalese” the average person would not understand, a skilled attorney may be able to hold the business responsible. However, if the document was clearly written and voluntarily signed, it may be harder to challenge its validity.

HAVE A DAZZLING 4TH OF JULY AND AVOID A FIREWORKS FIASCO: IMPORTANT FIREWORK SAFETY INFORMATION 3 Jul 2024, 3:30 pm
Fireworks are a tradition at 4th of July celebrations across the country, from hand-held sparklers to breathtaking professional displays. While fireworks make the holiday more festive, a happy occasion can turn tragic in a matter of seconds when someone is seriously hurt. In fact, last year eight people were killed in fireworks accidents and 9,700 people received emergency treatment for fireworks-related injuries. In addition, private citizens have to adhere to various state and local laws that regulate when and where fireworks can be set off as well as which kinds are permitted for personal use.
Here is a guide to using fireworks safely and lawfully this holiday weekend.
WHAT DAYS ARE FIREWORKS ALLOWED UNDER MICHIGAN LAW?
While Michigan law regulates the use of fireworks across the state, some municipalities have their own ordinances. Therefore, it is wise to check with your city, township or other local government entity to learn the rules that apply to your neighborhood.
Following is a list of dates and time periods when fireworks are allowed. Although fireworks are most commonly associated with the 4th of July, they are permitted on other holidays as well.
- New Year’s Eve (Dec. 31) from 11 a.m. through New Year’s Day (Jan. 1) at 1 a.m.
- Saturday and Sunday immediately before Memorial Day from 11 a.m. until 11:45 p.m. each day
- Saturdays and Sundays from June 29th through July 4th from 11 a.m. until 11:45 p.m. each day
- July 5, if it falls on a Friday (as it does this year), or Saturday from 11 a.m. until 11:45 p.m.
- Saturday and Sunday immediately before Labor Day, from 11 a.m. until 11:45 p.m. each day
However, state and local governments and fire departments can prohibit fireworks at any time because of hazardous weather conditions or other circumstances that would pose a safety risk.
In addition, it is illegal for anyone under the age of 18 to purchase fireworks. The law also prohibits using fireworks while under the influence of alcohol and/or drugs. Violating a fireworks law may result in a fine of up to $500. Fireworks sellers who violate laws can be subject to higher fines.
ARE THERE LAWS ABOUT WHERE PRIVATE CITIZENS CAN SET OFF FIREWORKS?
Yes. Consumer-grade fireworks, the kind sold to the public at retail outlets, may only be used on private property such as a home. Fireworks can be used on someone else’s property as long the owner gives permission.
It is illegal to set off fireworks on public property such as schools, religious institutions, community centers or sidewalks.
Aerial fireworks such as Roman candles and bottle rockets are not permitted at Michigan state parks, trails and harbors.
“Novelty” fireworks such as sparklers, snakes and poppers may be used at state parks and campgrounds.
However, because fireworks are known to trigger PTSD in people who served in combat zones, the Michigan Department of National Resources, in cooperation with the Michigan Veterans Affairs Agency, encourages those using campgrounds and parks to consider other ways to celebrate the holiday.
WHICH KINDS OF FIREWORKS ARE PERMITTED FOR PERSONAL USE?
Individuals can use the following types of fireworks as long as they comply with the specified days and times and are used only on private property:
Aerial fireworks
- Roman candles
- Bottle rockets
- Missile type rockets
- Aerials
- Reloadable shell devices
- Firecrackers
- Helicopter/aerial spinners
- Single tube device with report
Novelty items and low-impact fireworks*
- Sparklers
- Snaps
- Poppers
- Snakes
- Ground sparkling devices
- Ground-based or handheld sparklers
- Smoke devices
*These may be used at state parks and campgrounds.
FIREWORKS SAFETY TIPS
Because fireworks are classified as hazardous substances under the Federal Hazardous Substances Act (FHSA), it is important to use them safely. This includes sparklers, which look harmless but can become hot enough to melt metal.
These fireworks safety tips will help you enjoy the holiday and avoid injuries:
- Never allow young children to play with or ignite fireworks
- Have an adult supervise all fireworks activities
- Never lean over a fireworks device when you light the fuse
- Do not point or throw fireworks at another person
- Keep a hose or bucket of water nearby when using fireworks
- Douse used fireworks thoroughly before discarding
- Remember that sparklers can reach temperatures of 2,000 degrees Fahrenheit and should not be used by children without adult supervision
- Check the rules for using fireworks in your area as some municipalities have ordinances that differ from state laws
- Only purchase and use fireworks that are labeled for consumer (not professional) use
- Never use fireworks while impaired by alcohol or drugs
- Light fireworks one at a time and move back quickly after lighting
- Thoroughly soak and discard malfunctioning fireworks rather than trying to relight them
- Avoid placing any part of your body directly over a fireworks device when lighting the fuse
- Never point or throw fireworks, including sparklers, at other people or pets

Anything that takes your hands, eyes or mind off the road is considered a distraction, and visual-manual activities, such as texting, are the most dangerous. In fact, taking your eyes and attention off the road for five seconds at 55 mph is comparable to driving the length of an entire football field blindfolded.
In addition, the brain remains distracted for 27 seconds after interruptions such as texting using voice commands, making or answering a call or changing a radio station.

BUCKLE UP FOR SAFETY
Multiple traffic safety studies show seat belts and car seats save lives and help prevent serious injuries.
In Michigan, drivers, front-seat passengers and anyone 15 or younger (in any seat position) must wear a seat belt.
Children four and under must ride in the back seat whenever possible.
And, all children under eight years old or less than 4’9” tall should use a car seat or booster seat sized in accordance with their height, age and weight.

DOES MY MICHIGAN NO-FAULT INSURANCE COVER OUT-OF-STATE ACCIDENTS?
Generally, yes. According to Michigan law (MCL 500.3111), victims are eligible for Personal Injury Protection (PIP) benefits for accidents within the United States, its territories and possessions or Canada when the victim is:
- The named insured person under a Michigan No-Fault policy
- The spouse of a named insured person
- A relative living in the same household
- An occupant of a vehicle involved in the accident as long as:
- The victim resides in Michigan, or
- The owner or registrant of the vehicle is covered under a Michigan No-Fault policy
Therefore, an out-of-state resident who is injured while driving or riding in a vehicle insured by a Michigan No-Fault policy may be entitled to PIP benefits under the policy covering the vehicle.
