Debunking the Myth of Frivolous Lawsuits 3 Nov 2024, 3:42 pm

Article By: Britney L. Hebert – Attorney at Law

In the landscape of personal injury law, there is a prevalent myth about the existence of so-called ‘frivolous’ lawsuits. These are claims perceived as groundless, serving only to waste court resources and benefit the claimant with undeserved compensation. However, this narrative overlooks the stringent legal processes that scrutinize every claim and the serious consequences for those who attempt to abuse the system.

The justice system is built on a foundation that requires concrete proof and substantial evidence for a case to proceed. Before a personal injury lawsuit can even approach a courtroom, it must clear a series of hurdles: evidence must be gathered, witness testimony collected, and a compelling argument made that demonstrates the injury and its connection to the defendant’s actions.

Should an individual attempt to bring forth a frivolous claim, not only are they likely to face an early dismissal of their case due to lack of evidence, but they may also incur significant penalties. The courts do not take kindly to the misuse of their time. For lawyers and claimants, filing a claim without merit might lead to sanctions, fines, and even disbarment for the attorneys involved.

Moreover, most personal injury attorneys work on a contingency fee basis, meaning they only get paid if the case is successful. It is not financially prudent for a lawyer to invest time and resources in a case that lacks substance. This contingency system acts as a natural filter against frivolous claims. It must be understood that personal injury law exists to give a voice to those unjustly hurt and to help them reclaim their lives after an injury. Unfounded cases are not the norm and are discouraged by the very fabric of the legal system.

At The Glenn Armentor Law Corporation, we stand committed to championing the cause of those genuinely affected by negligence. Our mission is to support our clients through robust representation and uphold the integrity of the judicial process. We believe in the power of justice and the imperative of rightful compensation.

Understanding Louisiana’s “No Pay No Play” Law: Why Auto Insurance is Essential 3 Oct 2024, 2:20 pm

Article By: Britney L. Hebert – Attorney at Law

The Importance of Carrying Compulsory Liability Insurance

In Louisiana, the “No Pay No Play” law—codified in LA R.S. 32:866—impacts drivers without compulsory auto liability insurance, even when they are not at fault in an accident. This law limits your ability to recover damages after an accident if you are uninsured. Specifically, you cannot claim the first $15,000 for bodily injury and $25,000 for property damage, even when liability is clear.

Key Points of Louisiana’s “No Pay No Play” Law:

  • Uninsured Drivers: Even careful, law-abiding drivers are subject to this law if they lack mandatory liability coverage.
  • Restricted Compensation: Uninsured drivers cannot claim damages for the first $15,000 in bodily injury and $25,000 in property damage, even if they are not at fault.
  • The Importance of Compliance: Carrying compulsory liability insurance is crucial not only to comply with state law but also to protect your right to fair compensation in the event of an accident.

Why You Need Auto Liability Insurance

Maintaining auto liability insurance is essential to safeguard your financial and legal interests. Insurance acts as a safety net, ensuring you won’t face unnecessary legal or financial obstacles after an accident. Without it, you risk limited recovery under the “No Pay No Play” law, which can significantly impact your ability to recover damages, even when the other party is clearly at fault.

Protect Your Rights and Your Future

Driving uninsured in Louisiana is a gamble with serious consequences. Whether you’re involved in a minor fender-bender or a major accident, being uninsured can prevent you from accessing the full compensation you deserve. Don’t let the “No Pay No Play” law dictate your recovery options. Stay insured, and ensure that you have legal recourse in case of an accident.

If you need legal assistance navigating this law or any other auto accident-related legal matters, our team at The Glenn Armentor Law Corporation is here to help.

The Glenn Armentor Law Corporation Donates Pet Food to Local Shelters After Pet Week Contest 20 May 2019, 2:26 pm

The Glenn Armentor Law Corporation held an online, Facebook-based contest to celebrate Pet Week. Attorneys and staff submitted pictures of their beloved pets to The Glenn Armentor Law Corporation’s Facebook page, allowing the public to vote for their favorite pets. For each vote, our firm promised to donate a pound of food to various local shelters and agencies.

Because there was such overwhelming participation in the contest—almost 4,000 votes—we wanted to make sure our donations were used to the best possible end. These amazing foundations need much more than just food, so while we donated 200 pounds of food to each organization, we also gifted them with a $200 monetary donation to spend on other items for their animals!

The donations were given to The Pet Food Pantry (A Division of FoodNet Food Bank of Lafayette), Iberia Humane Society DBA Angel Paws Adoption Center, Animal Rescue Foundation of Louisiana, Inc., Safe Haven Animal Rescue, Wild Cat Foundation, Acadiana Animal Aid, Animal Aid for Vermillion Area, Louisiana Imagine No Kill, Second Chance Paws, Friends of Lafayette Animal Shelter, St. Landry Parish Animal Control and St. Martin Humane Society.

The winning dog was Bindi, who belongs to Attorney Britney Hebert. Runner-ups were Inga (who also belongs to Britney Hebert) and Cesar, who belongs to Attorney Jeremy Bazile.

The Glenn Armentor Law Corporation supports Concierge-Receptionist Genevieve Joubert in 2019 Greater Acadiana Heart Walk 4 May 2019, 3:34 pm

Despite the rainy weather, #TeamGen and The Glenn Armentor Law Corporation had a remarkable time supporting the 2019 Greater Acadiana Heart Walk. Genevieve Joubert, a GALC concierge-receptionist, underwent a life-altering heart transplant in 2016 that saved her life. Since then, Genevieve has devoted herself to appreciating every moment and spreading kindness as a tribute to her anonymous donor.

The American Heart Association (AHA) is a non-profit organization fighting heart disease and stroke. It is committed to promoting cardiovascular health and providing resources for prevention, treatment, and research. The AHA works tirelessly to educate the public about the importance of heart health, advocate for policies that support healthy lifestyles, and fund innovative research to improve patient care and outcomes.

The Greater Acadiana Heart Walk is an annual event that raises funds for the American Heart Association. By participating in the walk, we celebrated Genevieve’s incredible journey and contributed to the AHA’s mission of saving lives and improving cardiovascular health. Together, we made a difference in the fight against heart disease and showed our support for those who have undergone life-saving procedures. Through events like the Greater Acadiana Heart Walk and the dedication of individuals like Genevieve, we can raise awareness about heart disease and inspire others to take charge of their heart health. The American Heart Association continues to be a leading force in the battle against cardiovascular diseases, working towards a future where heart disease is no longer the leading cause of death.
